Notice to the Public: Proposed Alternative Requirements on Application for New Water Service Connection

PROPOSED ALTERNATIVE REQUIREMENTS
ON APPLICATIONS FOR A NEW WATER SERVICE CONNECTION


GENERAL POLICY
: The Zamboanga City Water District recognizes ownership of property as one of the most
important aspects of society. As such, it gives premium to property owners in processing applications for water
service connection. It however recognizes the fact that much of the contemporary residents in the City of
Zamboanga are not necessarily registered property owners, but are either lawful possessors thereof in whatever
capacities, or otherwise may be considered as informal or illegal settlers therein.

 

PROOF OF OWNERSHIP REQUIREMENTS FOR APPLYING FOR A NEW WATER SERVICE
CONNECTION
:


1. Certified true copy of the Transfer Certificate of Title (
TCT) indicating the applicant as the registered
owner thereof shall be submitted.


2. In case the applicant is other than the registered owner, a Special Power of Attorney (
SPA) or a
notarized Letter of Authority (
LOA) from the registered owner shall be submitted.


3. Where the applicant claims that he is a transferee of the property by way of sale, donation, or any other
legal modes of transfer of ownership, but the transfer of title in his name is still under process, he may
submit
in lieu of the SPA or LOA, the Contract evidencing such transfer (Absolute Deed of Sale, Deed of
Donation, Extra-judicial Settlement of Estate with Sale, Deed of Partition
, etc…).


FOR APPLICANTS WHO ARE NOT PROPERTY OWNERS, OR THOSE WHO FAIL TO SECURE THE
SIGNATURES OF THE PROPERTY OWNER, THE FOLLOWING SHALL BE SUBMITTED:


A signed and duly notarized WAIVER which shall serve as temporary replacement of the copy of the land title
and/or SPA or LOA, in which case the water service connection may be approved
ON CONDITIONAL
STATUS
.


The Waiver shall indicate that in the event that the owner of the property where the water service connection is
installed shall complain to ZCWD and shall request ZCWD to have the particular service connection
disconnected for the reason that he/she did not give his authority therefor, or where a previous authority was
given, that he is revoking such authority, the ZCWD is given the full authority to effect such disconnection
without further legal action
except notice to current users thereof.


The Waiver shall also state that the applicant is waiving all actions to refund all costs, fees and charges paid for
the purpose of processing and installing the water service connection, and that all unpaid bills, surcharges and
illegal connection penalties shall be paid by him. (
